1. 本規約の適用

本規約は、黄島成（Naru Kijima、以下「運営者」）が運営するウェブサイト narukijima.ai（以下「本サイト」）が公開するすべてのコンテンツ（記録・投稿・記事・週刊・月刊、および llms.txt・フィード等の機械可読サーフェスを含む）の利用条件を定めるものです。

利用前に本規約をご確認ください。本サイトは、閲覧や取得だけで利用者・エージェント運用者の明示的な同意を記録する仕組みではありません。ライセンスの適用と契約の成立は区別されます。

2. コンテンツの性質

本サイトのコンテンツは、非公開のHuman Source（運営者本人の記録）をAIが読み、整理し、編み直した二次情報です。原文そのものは公開されません。

各編集版は出典の記録ID（provenance: private:records:<id>）と本文のSHA-256（content_sha256）を保持し、サイトの各リリースは Naru Kijima Chain に追記されます。検証方法は https://narukijima.ai/verify/ に記載します。

AIによる編集物を含め、本サイトは運営者が蓄積・管理するデータ資産です。運営者が保有する著作権その他の権利は留保します。ただし、AI生成部分を含むすべての情報に著作権が発生するとは限らず、第三者の権利を運営者のものとする趣旨ではありません。

3. ライセンス

本サイトのコンテンツは、別段の表示がない限り、クリエイティブ・コモンズ 表示 - 非営利 - 改変禁止 4.0 国際ライセンス（CC BY-NC-ND 4.0）の下で提供されます。ライセンスの正文は https://creativecommons.org/licenses/by-nc-nd/4.0/ を参照してください。

このライセンスは、出典やライセンス表示などの条件を満たす、非営利・未改変の共有を認めています。本規約や機械可読な利用方針で、その許諾を取り消したり追加制限を課したりはしません。すでに与えたCCライセンスの許諾も維持されます。

法令により許諾なく認められる利用（引用など）は、本規約によって制限されません。AI学習・情報解析の適法性も、利用態様と適用法により異なります。

4. 許可される利用

以下の利用を許可します。

  • 閲覧および検索（検索エンジンによるインデックスを含む）
  • 出典（narukijima.ai と該当ページのURL）を明記した引用
  • AIエージェントによる読み取り・参照・要約（robots.txt の Content-Signal: ai-input=yes に対応）

引用・参照時の出典表記は「黄島成 (Naru Kijima) / narukijima.ai — <URL of the page>」の形式とします。

5. 禁止される利用

以下は運営者の利用方針です。第3条の既存ライセンスによる許諾・法定例外を妨げません。「権利留保」は、すべての利用を技術的に阻止できる、または一律に違法とする意味ではありません。

  • AI・機械学習モデルの学習目的への権利を留保し、追加の許諾は行いません（robots.txt の Content-Signal: ai-train=no に対応）
  • 別途許諾のない商用利用は認めません
  • 既存ライセンスの許諾範囲を超える転載・再配布は認めません。非営利・未改変でライセンス条件を満たす共有まで一律に禁止するものではありません
  • アクセス制御の回避や、サービスに支障を生じさせる大量自動取得は認めません
  • データセット化・学習用コーパスへの収録や第三者提供への権利を留保し、追加の許諾は行いません
  • 運営者を装う、または本サイトのコンテンツを運営者の記録・発言として偽って再利用するなりすまし行為（AIエージェントによるものを含む）

学習利用への権利留保は、適用される範囲でEU指令2019/790第4条3項に基づくTDM（テキスト・データマイニング）のopt-outの表明を含みます。既存の許諾や法定例外に優先するものではありません。robots.txt の Content-Signal（ai-train=no）などでもこの方針を表明します。

6. AIエージェント・自動化による利用

AIエージェント、クローラー、自動化ツールの運用者は、取得・利用前に本規約と利用方針を確認してください。公開ページの取得を、運用者本人による明示的な同意の証拠とは扱いません。

エージェントは、取得したコンテンツに付随するfrontmatterの rights（ライセンス・利用条件・出典表記）と末尾の権利表記を保持し、出力に含める要約・引用には第4条の出典表記を付してください。

利用方針は、robots.txt の Content-Signal、HTTPレスポンスの TDM-Reservation / TDM-Policy ヘッダー、HTMLの tdm-reservation メタタグ、/.well-known/tdmrep.json、および各Markdownの rights frontmatter にも記載します。これらは意思表示であり、取得を完全に防ぐ技術的なアクセス制御ではありません。

7. 免責

本サイトの内容は特定時点における運営者個人の思考の記録であり、予告なく変更されることがあります。運営者は内容の正確性・完全性を保証しません。

本サイトの内容は、投資・法律・医療その他の専門的助言ではありません。

運営者は、本サイトの利用により生じたいかなる損害についても、運営者の故意または重過失による場合を除き、責任を負いません。

8. 規約の変更

運営者は、必要に応じて本規約を変更できます。変更後の規約は、本ページに掲載した時点から効力を生じます。

9. 準拠法・管轄

本規約は日本法に準拠します。本サイトおよび本規約に関する一切の紛争は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

10. 言語

本規約は日本語を正文とします。参考訳として英語版を併記しますが、日本語版と英語版に相違がある場合は日本語版が優先します。

1. Scope

These Terms govern the use of all content published on narukijima.ai (the "Site"), operated by Naru Kijima (the "Operator"), including records, posts, daily articles, weekly digests, monthly retrospectives, and machine-readable surfaces such as llms.txt and feeds.

Review these Terms before use. Viewing or fetching alone does not record express assent from a user or an agent operator. License acceptance and formation of a separate contract are distinct matters.

2. Nature of the Content

The content on this Site is secondary information: private human-authored source records of the Operator, read, organized, and re-edited by AI. The original source texts are not published.

Each edited version retains its source record ID (provenance: private:records:<id>) and a SHA-256 of its body (content_sha256); every release of the Site is appended to the Naru Kijima Chain. See https://narukijima.ai/verify/ for how to verify.

The Site, including AI-edited material, is a data asset maintained by the Operator. Rights held by the Operator are reserved. Not every item of information or AI-generated passage necessarily qualifies for copyright; third-party rights remain with their holders.

3. License

Unless otherwise noted, the content on this Site is licensed under the Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 International License (CC BY-NC-ND 4.0). See https://creativecommons.org/licenses/by-nc-nd/4.0/ for the license text.

This license permits noncommercial sharing of unmodified material when its attribution and other conditions are met. These Terms and machine-readable policies do not revoke or add restrictions to that grant. Previously granted CC licenses remain effective.

Statutory exceptions, including applicable quotation rights, are unaffected. Whether AI training or data analysis is permitted by law depends on the use and applicable law.

4. Permitted Uses

  • Viewing and search (including indexing by search engines)
  • Quotation with attribution (narukijima.ai and the URL of the page)
  • Reading, referencing, and summarizing by AI agents (per Content-Signal: ai-input=yes in robots.txt)

Attribution format for quotation and reference: "黄島成 (Naru Kijima) / narukijima.ai — <URL of the page>".

5. Prohibited Uses

The following states the Operator's usage policy, subject to the existing license grants and statutory exceptions in Section 3. A reservation of rights is neither a technical block nor a claim that every such use is unlawful.

  • Rights are reserved for AI/ML training; no additional permission is granted (Content-Signal: ai-train=no)
  • Commercial use requires separate permission
  • Redistribution outside the license grant is not permitted; noncommercial, unmodified sharing that meets its conditions is not categorically prohibited
  • Circumventing access controls or automated collection that disrupts the service is not permitted
  • Rights are reserved for dataset inclusion and supply to training corpora or third parties; no additional permission is granted
  • Impersonating the Operator, or passing the content off as the Operator's records or statements in derivative uses (including by AI agents)

Where applicable, this includes a TDM reservation under Article 4(3) of Directive (EU) 2019/790. Existing licenses and statutory exceptions remain unaffected. The policy is also signaled via Content-Signal: ai-train=no in robots.txt.

6. Use by AI Agents and Automation

Operators of AI agents, crawlers, and automation tools should review these Terms and usage policies before fetching or using content. A public fetch is not treated as evidence of the operator's express assent.

Agents must preserve the rights frontmatter (license, usage terms, attribution) and the trailing rights notice that accompany fetched content, and must attach the attribution in Section 4 to summaries and quotations in their output.

Policies are also expressed via Content-Signal in robots.txt, TDM-Reservation / TDM-Policy headers, tdm-reservation HTML metadata, /.well-known/tdmrep.json, and Markdown rights frontmatter. These are usage signals, not technical access controls that prevent all collection.

7. Disclaimer

The content records the Operator's personal thinking at a specific point in time and may change without notice. The Operator does not warrant its accuracy or completeness. Nothing on this Site constitutes investment, legal, medical, or other professional advice.

The Operator is not liable for any damages arising from use of the Site, except in cases of willful misconduct or gross negligence.

8. Changes

The Operator may amend these Terms as needed. Amended Terms take effect when posted on this page.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over any dispute relating to the Site or these Terms.

10. Language

The Japanese text of these Terms is the authoritative version; this English translation is provided for convenience. In case of any discrepancy, the Japanese version prevails.
